1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of the website located at https://pkrest.com (the "Site"), our online forms and chat widget, our text messaging and email programs, and your communications with Promise Keepers Restoration LLC ("Promise Keepers Restoration," "we," "us," or "our").

By accessing the Site, submitting a form, using our chat widget, consenting to receive text messages, or otherwise communicating with us, you agree to these Terms. If you do not agree, do not use the Site or submit your information to us.

These Terms incorporate our Privacy Policy by reference.

2. Eligibility

You must be at least 18 years of age to use the Site, submit a request, or consent to receive messages from us. If you are submitting information on behalf of another person or a business entity, you represent that you are authorized to do so and to accept these Terms on their behalf.

3. What the Site Is and Is Not

The Site provides information about our roofing, siding, window, gutter, fencing, storm damage restoration, and related services in Colorado.

Submitting a form, scheduling an inspection, or receiving an estimate does not create a contract for work. No work is authorized and no contract exists between you and Promise Keepers Restoration until both parties sign a written agreement describing the scope, price, and terms of the project. That signed agreement governs the work itself and controls over anything on the Site or in these Terms.

Descriptions, photographs, pricing indications, warranty summaries, and service area information on the Site are provided for general information and are subject to change without notice.

4. Inspections, Estimates, and Proposals

We offer no-cost roof inspections within our service area. An inspection produces our assessment of the condition of your property. It is not an engineering report, a structural certification, a home inspection as defined under any licensing scheme, or a guarantee of insurance coverage.

Estimates and proposals are valid for the period stated on the document. If none is stated, they are valid for 30 days. Estimates are based on conditions visible at the time of inspection. Concealed conditions discovered during the work — including deck damage, rot, code-required upgrades, or additional layers — may require a change order and additional cost.

5. Insurance Claim Assistance

If you ask us to assist with an insurance claim, we will document damage, prepare scopes and supplements, and communicate with your carrier or adjuster regarding the scope and cost of repairs.

We are not a public adjuster, an insurance agent, an attorney, or your legal representative. We do not adjust claims, do not represent you in negotiations with your insurer, and do not advise you on the interpretation of your policy or your legal rights under it. Colorado law restricts what a roofing contractor may do in connection with an insurance claim, and we operate within those restrictions. You remain solely responsible for your relationship with your insurer and for all decisions regarding your claim.

We do not pay, waive, rebate, or absorb any portion of your insurance deductible, and we will not offer to do so. Colorado law prohibits it.

Whether your claim is approved, the amount your insurer pays, and the scope your insurer agrees to are decisions made by your insurance company, not by us. We make no representation or guarantee about the outcome of any claim.

Residential roofing work in Colorado is governed by C.R.S. § 6-22-101 et seq., which provides certain rights to property owners, including the right to rescind a roofing contract within 72 hours after receiving notice that an insurance claim has been denied in whole or in part. Those statutory rights apply regardless of anything in these Terms.

6. SMS and Text Messaging Program Terms

This section governs text messages sent by Promise Keepers Restoration LLC.

6.1 Program Description

Promise Keepers Restoration LLC operates two text messaging programs:

• Informational and transactional messages — appointment confirmations and reminders, scheduling and rescheduling, inspection results, project status updates, crew arrival notifications, document delivery, and replies to your questions.
• Promotional messages — service offers, seasonal reminders, storm response notices, and other marketing communications.

6.2 Consent

You may enroll by checking the applicable consent box on a form or chat widget at https://pkrest.com or https://pkrest.com/contact and providing your mobile number. Consent boxes are not pre-checked, and each program is consented to separately. You may also enroll by giving verbal consent to a Promise Keepers Restoration representative during a call or an in-person visit, in which case we will record that consent.

Consent to receive text messages is not a condition of purchasing any goods or services from us. You may decline and still request an inspection, receive an estimate, and have work performed.

By enrolling, you confirm that you are the subscriber or the customary user of the mobile number you provide, and that you are authorized to consent to receive messages at that number. You agree to notify us if you give up that number.

6.3 Message Frequency

Message frequency varies depending on your interaction with us and the status of your project.

6.4 Cost

Message and data rates may apply. Your mobile carrier's standard rates apply to every message you send and receive. Contact your wireless provider with questions about your plan. We are not responsible for charges assessed by your carrier.

6.5 Opt-Out

Reply STOP to any message to cancel. You will receive one confirmation message and then no further messages from that program. You may also opt out by calling (720) 650-1116 or emailing peter@pkrest.com.

Opting out of one program does not automatically opt you out of the other. To stop all messages, reply STOP to each program or contact us directly.

To rejoin after opting out, enroll again the same way you did originally.

6.6 Help

6.7 Carrier Liability

Mobile carriers are not liable for delayed or undelivered messages. We do not guarantee that messages will be delivered, and delivery depends on factors outside our control.

6.8 Supported Carriers

Our messaging program is supported by major U.S. wireless carriers. Carrier participation may change without notice.

6.9 Privacy

Mobile phone numbers and SMS opt-in consent are never sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. See Section 4 of our Privacy Policy for full details.

7. Email Communications

If you provide your email address, you consent to receive service-related emails regarding your inquiry, inspection, estimate, or project. You may separately consent to marketing emails, and may unsubscribe from those at any time using the link in any marketing email. Unsubscribing from marketing email does not stop service-related email about an active project.

8. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law
• Submit false, misleading, or fraudulent information, or another person's contact information without their permission
• Attempt to gain unauthorized access to the Site, our systems, or any account
• Use automated means to scrape, harvest, or extract data from the Site
• Interfere with or disrupt the operation of the Site
• Reproduce, distribute, or create derivative works from Site content without our written permission
• Impersonate Promise Keepers Restoration or misrepresent your affiliation with us

We may suspend or terminate your access to the Site at any time, without notice, for any reason.

9. Intellectual Property

The Site and its contents — including text, graphics, logos, photographs, video, layout, and design — are owned by Promise Keepers Restoration LLC or our licensors and are protected by United States copyright and trademark law. The Promise Keepers Restoration name and logo are our trademarks. Nothing on the Site grants you any license or right to use them.

Photographs of completed projects appearing on the Site depict our work and may not be reproduced without permission.

10. Reviews, Testimonials, and Submitted Content

If you submit a review, testimonial, photograph, or other content to us or about us, you grant Promise Keepers Restoration LLC a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display that content in our marketing materials, on the Site, and on third-party review and social platforms, with attribution by first name and last initial unless you tell us otherwise.

You represent that you own or have the right to submit that content and that it does not infringe anyone's rights.

11. Third-Party Links and Services

The Site may link to or embed third-party websites, tools, financing partners, manufacturer warranty registries, and review platforms. We do not control those services and are not responsible for their content, availability, terms, or privacy practices. Your use of a third-party service is governed by that party's terms.

12. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT INFORMATION ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT.

This section applies to the Site only. It does not limit, modify, or disclaim any workmanship warranty, manufacturer warranty, or other warranty expressly provided in a signed contract for work performed at your property, or any warranty that cannot be disclaimed under Colorado law.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROMISE KEEPERS RESTORATION LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF YOUR USE OF THE SITE IS LIMITED TO ONE HUNDRED DOLLARS ($100).

This section applies to the Site and these Terms only. It does not limit our liability under any signed contract for work performed at your property, and it does not limit liability that cannot be limited under applicable law.

14. Indemnification

You agree to indemnify and hold harmless Promise Keepers Restoration LLC and its owners, employees, and contractors from any claim, demand, loss, or expense, including reasonable attorneys' fees, arising out of your violation of these Terms, your misuse of the Site, or your submission of another person's information without authorization.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Arapahoe County, Colorado, and you consent to the jurisdiction of those courts.

Nothing in this section waives any right you have under Colorado consumer protection law, including rights under C.R.S. § 6-22-101 et seq.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and post the revised Terms at https://pkrest.com/terms. Your continued use of the Site after we post changes constitutes acceptance of the revised Terms. Changes to Section 6 that materially affect the messaging program will be communicated to enrolled subscribers where required.

17. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Promise Keepers Restoration LLC regarding your use of the Site. Our failure to enforce any provision is not a waiver of that provision.

Work performed at your property is governed by the separate signed contract for that work, which controls in the event of any conflict with these Terms.
